By accessing or using Cross Paste ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Cross Paste is a clipboard synchronization service that allows users to share clipboard content across multiple devices using end-to-end encryption. The Service includes:
- Cross-platform clipboard synchronization
- End-to-end encrypted data transfer
- Clipboard history management (subject to plan limitations)
- Device linking via QR code authentication
3. User Responsibilities
You agree to:
- Use the Service only for lawful purposes
- Not attempt to circumvent security measures
- Maintain the security of your Recovery Key
- Not use the Service to transmit malware or illegal content
4. Intellectual Property
The Service and its original content, features, and functionality are owned by Cross Paste and are protected by international copyright, trademark, and other intellectual property laws.
5. Limitation of Liability
Cross Paste shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
6. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via the Service or email.
7. Account Termination
You may terminate your use of the Service at any time by deleting your account and all associated data through the app settings. We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.
8. Subscription and Payment Terms
Pro Subscriptions
Cross Paste offers a Pro subscription plan with enhanced features. By subscribing, you agree to:
- Pay the subscription fee as displayed at the time of purchase
- Automatic renewal unless you cancel before the renewal date
- Subscription fees are charged through your app store (Apple App Store, Google Play) or payment processor
Cancellation and Refunds
You may cancel your subscription at any time through your app store settings. Refunds are subject to the policies of your app store or payment processor. We do not provide direct refunds for subscriptions purchased through app stores.
9. Service Availability
We strive to provide reliable service but do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from Service unavailability.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROSS PASTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cross Paste, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.
13. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Cross Paste operates, without regard to its conflict of law provisions.
Dispute Resolution
If you have a dispute with us, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to resolve the dispute through binding arbitration, except as otherwise required by applicable law.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and other legal documents, constitute the entire agreement between you and Cross Paste regarding your use of the Service and supersede all prior agreements and understandings.
16. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via the Service, email, or by posting a notice on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
